The Heritage Foundation’s Oversight Project has uncovered disturbing evidence that former President Joe Biden may not have personally signed most of his administration’s Executive Orders and official documents. Instead, the investigation found identical autopen signatures on nearly all White House documents throughout Biden’s term, raising serious questions about his awareness of policies being implemented in his name.
Multiple news outlets, including Fox News Digital, DailyMail.com, and the New York Post, have independently verified that more than 20 Executive Orders from Biden’s presidency bear the exact same signature. This consistency suggests the widespread use of an autopen device, a machine that reproduces signatures, rather than the president personally signing these consequential documents.
Legal Questions and Cognitive Concerns
Republican Missouri Attorney General Andrew Bailey has demanded a Department of Justice investigation into the matter, saying, “I am demanding the DOJ investigate whether President Biden’s cognitive decline allowed unelected staff to push through radical policy without his knowing approval.” This serious allegation suggests Biden’s staffers may have exploited his deteriorating mental state to advance their agenda without proper authorization.
“For investigators to determine whether then-President Biden actually ordered the signature of relevant legal documents, or if he even had the mental capacity to, they must first determine who controlled the autopen and what checks there were in place,” the Oversight Project also stated in their report. Bailey has argued that if Biden was indeed exploited, the orders signed via autopen could be considered “null and void.”

Evidence of Presidential Confusion
Perhaps the most damning evidence comes from House Speaker Mike Johnson, who recounted a conversation with Biden about an Executive Order on energy exports. According to Johnson, when confronted about the order, Biden responded, “I didn’t do that,” suggesting he had no recollection of authorizing the policy.
Special Counsel Robert Hur’s assessment of Biden as “a sympathetic, well-meaning, elderly man with a poor memory” during his classified documents investigation adds weight to these concerns. The Oversight Project also noted that Biden’s signature on his letter withdrawing from the 2024 presidential race appeared markedly different from the autopen signature used on official documents, one of the few documents they believe he actually signed himself.
Biden’s old colleagues have not commented on these findings, which have sparked outrage among conservative social media users concerned about the constitutional implications of having unelected staffers potentially directing policy without proper presidential oversight.
