Ocasio-Cortez Says It’s Time To Bypass The Courts

Alexandra Ocasio-Cortez (D-NY) received her BA in international relations and economics from Boston University in 2011 but seemingly skipped any classes with the basics in law.

On Sunday, the former bartender turned congressman suggested that President Joseph Biden should disregard a federal judge’s decision to temporarily halt mifepristone’s approval, which has been in place for two decades.

U.S. District Judge Matthew Kacsmaryk issued a 67-page order in Amarillo, Texas, but it won’t take effect for a week, so the Biden administration may consider filing an emergency appeal. According to Reuters, the U.S. Department of Justice confirmed as much.

Putting aside legal considerations, AOC has urged Biden to disregard the verdict.

CNN’s “State of the Union” anchor Dana Bash was direct with the two-term congresswoman on Sunday morning’s episode.

Bash said the idea of just disregarding a judge’s stance is shocking.

She asked if the government should abide by the Supreme Court’s ruling if it bans this abortion drug.

Ocasio-Cortez wanted to take a step back and delve into the grounds behind disregarding the preliminary ruling. 

The term “agency non-acquiescence” has been adopted to describe this phenomenon.

AOC said Trump “did this very thing” as president.

She said It is not rare for authorities to maintain the status quo until a higher court issues a judgment.  

AOC said she believes that the executive branch has enforcement discretion, and when the judicial branch makes a mockery of our system, democracy, and our law, she thinks that the executive branch should implement enforcement discretion.

Once again, Bash asked, “Should that apply if the Supreme Court supports the Texas judge’s decision?”

In response, AOC said we must consider the reasoning behind that decision. She does not think the courts can legitimately assume the kind of control over the FDA.

That’s a catastrophe in the making, AOC stated.
